TPD Compliant Companies Agog at FDA Flaunting

Many people grumble about the TPD regulations we have to adhere to here in the UK but at the end of the day, such rules are designed to keep consumers safe. Looking at recent reports of a vaping company in the US flaunting FDA rules and including prescription drugs in two of their product lines has really shocked a lot of manufacturers and retailers who value their business and their customer base. The overwhelming reaction to this news has been “What were they thinking?”. Vaping has become very popular for obvious reasons and stunts like these are just unacceptable.

US Vaping Company Makes Bad Choices

Earlier this month the FDA had to pull up a vaping company in the US after finding that they had included prescription drugs in two of the e liquids they sell to consumers. These drugs (Tadalafil and Sildenafil) are both active ingredients in erectile dysfunction drugs and help with these issues. Aside from the ethical and legal implications of including drugs in e liquids, these particular drugs, while helpful to some, could cause serious issues for others.

Any vapers who are diabetic, have blood pressure issues, heart complaints, are pregnant or have various other risk factors in their lives could be seriously harmed by these medications. Ignoring the initial notice to pull the products the FDA has ensured the company have complied and have put out a public announcement warning anyone who has bought these e liquids to not use them and to discard them immediately. The FDA, as per law, keep a record of any reported side effects of products and drugs so if you know any of the relatively small sample of US vapers who used these e liquids they are urged to report any side effects to the FDA themselves.

Bad For Vaping Business

As well as being obviously concerned for consumers and agog at the fact that any company could ignore the rules so blatantly, UK vaping companies who adhere to TPD rules, and no doubt many reputable ones in the US are cross! As a vaping community, we have fought mistruths, myths, fake news and speculation about vaping, cheap e liquids, e cigarette devices and more. We have just, in recent years, reached a point where the public perception of vaping has changed significantly and vaping has become much more widely recognised as a good thing.

Public Health England, the group responsible for harm reduction and all public health matters now openly advocates for the use of e cigarettes as a way to help people move away from harmful tobacco smoking once and for all. In their spring 2018 review they announced that vaping is at least 95% less harmful (at least!) and should be made more accessible to all, including being available on prescription. This was a massive leap forward for vaping and will help so many more people quit smoking and lead healthier lives. A company flaunting all the US rules in the way they did when we’ve come so far angered many. Thankfully it seems that consumers recognise that it was an isolated issue.

The TPD legislation governs e liquids and covers everything from how much nicotine you may have in a bottle, how big a bottle of e liquid may be sold, testing regulations, tight advertising rules, labelling directives and more.
